Acceptance of Terms
The services of the SPHERE CARD® website, associated pages,
and mobile applications (collectively, the “SphereCard Services”) are
provided subject to your acceptance of these Terms of Service (“Terms”),
without modification.
By accessing or using SphereCard Services via website,
mobile application, or other access methods, you agree to be bound by all
terms, conditions, and notices contained herein. These Terms apply to all
directly connected pages and affiliated SphereCard websites.
SPHERE CARD® reserves the right to modify these Terms at any
time. Updates will be posted, highlighted, and dated within this section.
Continued use of SphereCard Services following any update constitutes
acceptance of the revised Terms.
Eligibility & Responsibility
SphereCard Services may only be purchased and used by
freelancers, businesses, and entrepreneurs legally permitted to perform
services within their applicable jurisdiction.
Vendors are solely responsible for:
- The
accuracy of information displayed on their SphereCard
- Compliance
with applicable laws and regulations
- The
legality and appropriateness of their services and content
SphereCard does not verify professional licenses,
credentials, or qualifications unless expressly stated.
VeriSatisfied™ Badge & Resolution System
SphereCard utilizes a badge-based resolution system
designed to promote accountability, professionalism, and constructive outcomes
rather than public scoring or star ratings.
Badge Participation
- Vendors
are automatically enrolled in the VeriSatisfied™ Badge & Resolution
System.
- Compliments
submitted by registered users may be displayed publicly on a vendor’s
SphereCard.
- Badge
status reflects current standing, not permanent or historical
judgment.
Complaints & Resolution
- Complaints
must be submitted by registered SphereCard users.
- Vendors
are notified of complaints and provided up to 14 days to respond
and attempt resolution.
- Unresolved
complaints within this timeframe may result in the temporary removal of
the VeriSatisfied™ Badge.
- Upon
successful resolution, badge status may be restored.
Badge removal does not constitute a finding of wrongdoing,
fault, or liability.
Manual Administrative Intervention
If resolution is not possible due to circumstances outside
the vendor’s control, vendors may submit a support ticket requesting manual
administrative intervention by SphereCard.
Manual Intervention Fee
- If
SphereCard must engage in administrative review, the vendor may be
required to pay a flat administrative fee before review.
- This
fee reflects administrative time and platform resources only.
- Payment
does not imply favoritism, endorsement, or guarantee of outcome.
- Manual
intervention does not constitute dispute resolution, arbitration,
mediation, or legal judgment.
Administrative assessments are based solely on
correspondence exchanged between the customer and the vendor within the
SphereCard platform. No additional evidence, documentation, or appeals will be
requested or accepted.
Manual Administrative Review Policy
SphereCard allows vendors to request a manual administrative
review of possible reinstatement of the VeriSatisfied™ Badge.
- The first
administrative review request is provided at no cost.
- Each
subsequent request is subject to a $50.00 USD processing fee.
An administrative review consists of a final administrative
assessment of the vendor’s documented responsiveness, professionalism, and
resolution effort demonstrated during the initial resolution process.
Payment of any administrative review fee does not affect
outcomes or guarantee badge reinstatement.
This policy exists to preserve system integrity and
encourage timely, good-faith resolutions between vendors and customers.
SphereCard Complaint Resolution Policy
SphereCard provides a structured process to facilitate
communication between consumers and vendors.
SphereCard does not act as:
- A
legal authority
- An
arbitrator
- A
mediator
- An
enforcement body
Participation in the SphereCard Resolution System does not
limit either party’s right to pursue external remedies.
Scope
This process applies solely to complaints submitted through
the SphereCard platform relating to vendor interactions.
Process Overview
- Consumers
submit complaints through their SphereCard account.
- Vendors
receive notification and are provided with a limited timeframe to respond.
- Vendors
are permitted one initial response and one final response.
- Consumers
may review vendor responses before case closure.
- Cases
are closed based on response timelines, completion of the process, or
non-response.
Timeframes
SphereCard aims to facilitate resolution within 14 days,
subject to all parties' participation.
Finality
Once a case is closed, no further responses or modifications
may be submitted through the platform.
Visibility
- Resolution
communications are private between participating parties.
- Only badge
status and compliments are publicly visible.
Limitation of Responsibility
SphereCard facilitates communication and administrative
processes only and does not:
- Verify
claims or evidence
- Make
legal determinations
- Enforce
outcomes
- Guarantee
resolutions or satisfaction
Fraud No-Tolerance Policy
Allegations of fraud or scams result in immediate
suspension of the vendor’s SphereCard pending review.
- Vendors
must resolve fraud allegations within their license term.
- License
renewal is prohibited while fraud allegations remain unresolved.
- Vendors
are responsible for submitting proof of resolution, including written
confirmation from the complainant, to support@findmyspherecard.com
for reinstatement.
Cancellation Policy
- Cancellation
takes effect at the end of the current billing term.
- Cancellation
requests must be submitted in writing to support@findmyspherecard.com.
- Removal
from the default free basic plan also requires a written request.
Services & Disclosures
By accessing SphereCard Services, you agree to comply with
all applicable laws and regulations.
Applicable copyright and trademark laws protect all
materials within SphereCard Services.
License Restrictions
You may not:
- Modify,
copy, or redistribute SphereCard materials
- Use
materials for public or commercial display outside SphereCard Services
- Attempt
to decompile or reverse engineer SphereCard software
- Remove
proprietary notices
- Mirror
materials on other servers
Disclaimer
SphereCard Services are provided “as-is” without
warranties of any kind. SPHERE CARD claims all implied warranties, including
merchantability, fitness for a particular purpose, and non-infringement.
SphereCard makes no guarantees regarding accuracy,
reliability, or results of use.
Voice or video calls made through the SphereCard app may
incur carrier charges.
Limitation of Liability
SPHERE CARD® and its suppliers shall not be liable for any
damages, including loss of data, profits, or business interruption, arising
from use or inability to use SphereCard Services, even if advised of the
possibility of such damages.
Certain jurisdictions may not allow limitations of
liability; applicable laws may apply.
Governing Law
These Terms are governed by and construed under the laws of
the State of Delaware, USA, without regard to conflict-of-law
principles. You irrevocably submit to the exclusive jurisdiction of the courts
located in Delaware.
